The detailed indictment as signed by the grand jury on May 26, 2005 is here:
http://seattletimes.nwsource.com/news/local/links/emeryindictment1005.pdf
The indictment charges are summarized at the bottom of the first page of the July 28, 2005 search warrant. The multi-page search warrant is currently on page 3 of this gallery. There may a possibility that the death penalty may apply according to this CC forum thread. The exact law is the 1988 "Drug Kingpin Statute". In 1994 under admitted potsmoker Newt Gingrich's leadership the list of crimes providing for the death penalty was modifed to include "Trafficking in large quantities of drugs." That includes trafficking in over 30,000 seeds.

Click for rally photos! U.S. is seeking life in prison for Marc Emery for selling cannabis seeds to the USA. Holland, the UK, etc. sell seeds to the USA. The USA hasn't been trying to extradite their seed sellers! Seed selling is legal in those nations, and it is tolerated in Canada. Even Health Canada has sent patients to Canadian seed sellers! Canada sent plenty of liquor to the USA during its alcohol prohibition. The USA couldn't arrest those sellers if they didn't enter US territory. Please forward widely:

"In a statement, DEA administrator Karen Tandy said Emery and his organization was 'one of the attorney general's most wanted international drug trafficking organizational targets -- one of only 46 in the world, and the only one from Canada.' Jeff Sullivan, assistant U.S. attorney, said it could be 'anywhere from six months to two years before [Emery] is in America facing charges.' "

"Today's arrest of Mark (sic) Scott Emery, publisher of Cannabis Culture magazine and the founder of a marijuana legalization group, is a significant blow not only to the marijuana trafficking trade in the U.S. and Canada, but also to the marijuana legalization movement. ... Hundreds of thousands of dollars of Emery's illicit profits are known to have been channeled to marijuana legalization groups active in the United States and Canada. Drug legalization lobbyists now have one less pot of money to rely on."

Great quote from an August 8, 2005 article:
http://www.howestreet.com/mainartcl.php?ArticleId=1441
____ "If sending marijuana seeds in the mail is illegal here, as in the US, the 'crime' was clearly committed in Canada, not the US and the Canadian government should simply tell the US government, okay, we'll prosecute the fellow here since the 'crime; was committed here. Then Marc can plead guilty, pay his fine and continue with his life. But to send him to the United States would be absurd as well as a gross perversion of justice.
____ "Marc is following in the footsteps of one of Canada's largest industrial conglomerates - Seagram's, which made a fortune and established its presence as one of Canada's leading companies in the thirties during prohibition. Seagram's products were smuggled in huge quantities south of the border. This saved thousands of Americans from blindness or death due to bad moonshine. Would the Canadian government of the day have extradited the Seagrams and new company owners the Bronfmans at the request of the Americans?"
